TOWN OF STAFFORD TOWN BOARD MEETING
DECEMBER 9, 2024
The Town of Stafford Town Board Meeting was called to order at 7:30pm with Supervisor Clement leading the Pledge of Allegiance. In attendance were Councilman Panek, Councilman Young, Councilman Duyssen, Councilman Pacer, Highway Superintendent Boldt and Town Clerk Radley.
Also, in attendance were, Cathy Worthington, Barbie Starowitz, Andrew Darling, Charlie Giacchino, Laurie and Zack Pocock.
Councilman Pacer made a motion to approve the Financial Report, Councilman Duyssen second and the motion was approved on a 5-0 vote.
Councilman Panek made a motion to approve the Public Hearing minutes of November 11, 2024 on the 2025 Budget with one change to the rates, second by Councilman Pacer and approved on a 5-0 vote.
Councilman Young made a motion to approve the Public Hearing minutes of November 11, 2024 on Tax Cap Override, second by Councilman Pacer and approved on a 5-0 vote.
Councilman Panek made a motion to approve the monthly Town Board Meeting minutes of November 11, 2024, second by Councilman Young and approved on a 5-0 vote.
Councilman Young made a motion to approve the Emergency Special Meeting Minutes of November 27, 2024, second by Councilman Duyssen and approved on a 5-0 vote.
Councilman Young made a motion to approve the Fire Department Report, second by Councilman Panek and approved on a 5-0 vote.
Councilman Pacer made a motion to approve the ZEO/CEO Report, second by Councilman Panek and approved on a 5-0 vote.
Councilman Young made a motion to approve the Assessor Report, second by Councilman Panek and approved on a 5-0 vote.

Recreation Director Laurie Pocock gave her report of the 2024 Summer Youth Recreation Program. There were 50-60 participants with many first-time children,
the main age group is the 5–8-year-olds, the oldest children were 13-year-olds. They enjoyed the program very much, a great group of counselors as well as children. Four field trips were provided, Minnehans in Livonia, Red Wings game, Altitude, and Darien Lake, much fun was had. They swam on Tuesdays at the Stafford Country Club, thanks to the Highway Department for maintaining a safe walkway to the Country Club. They enjoyed a Penny Carnival which the proceeds went to a fundraiser for Hailey Coniber who is battling Childhood Cancer, went to the Fire Department for a tour of the building and ambulance; had a movie night, laser tag at night, water balloons and Kidde pools for the hot summer, sprinklers, crafts and sports. A July 4th picnic was a highlight as well and a talent show.
Each child received a paper plate award for talents shown through the program. A donation of $250.00 was given by the Jett family; that is appreciated. The end of the year party was held at the Fire Hall because of inclement weather.
Miss Stafford is Ella Morrow and Remi Liles is runner up; Mr. Stafford is Hayden LaBarge with runner up Weston Morrow.
Councilman Young thanked Laurie for the wonderful job she is doing, Laurie pays attention to all details and spends a lot of time overseeing the children and staff, more than anyone in the past. Councilman Young then reported that some work will be done to the park next year, resurfacing the Tennis Courts, Basketball and Pickleball Courts, fixing the pavilions as far as the concrete work, new doors on the storage shed which is badly needed; all from the ARPA funds. The work should be done before the summer program starts but if not, will be worked around the schedule of the park program. The Town is striving for safety for the children at the park.
Councilman Young made a motion to approve Resolution 83 to Enter into a Contract with the Fire Department, second by Councilman Panek and approved on a 5-0 vote.

RESOLUTION 83 TO ENTER INTO AN AGREEMENT
REGARDING THE 2025 AGREEMENT FOR FIRE PROTECTION SERVICES
FOR THE STAFFORD FIRE PROTECTION DISTRICT

The Town Board of the Town of Stafford met at a regular board meeting at the Town Offices of the Town of Stafford located at 8903 Route 237, Stafford, New York on the 9th day of December, 2024 commencing at 7:00 P.M., and thereafter a public hearing was held at 7:15 P.M. at which time and place the following members were:

WHEREAS, all Board Members, having due notice of said meeting, and that pursuant to Article 7, §104 of the Public Officers Law, said meeting was open to the general public and due and proper notice of the time and place whereof was given as required by law; and
WHEREAS fire protection services are vital and necessary to the health and welfare of the inhabitants of the Town of Stafford; and
WHEREAS Stafford Fire Department Inc. maintains adequate and suitable vehicles, apparatus and equipment to furnish fire protection services in the Stafford Fire Protection District; and

WHEREAS, pursuant to Article 5-G of the General Municipal Law (§§119-M – 119-OO) authorizes municipal corporations and districts to enter into agreements for the performance among themselves or one for the other of their respective functions, powers or duties on a cooperative or contract basis or for the provision of a joint service (General Municipal Law, §119-O[1]; see also General Municipal Law, §119-O[3], relative to mutual sharing plans); and
WHEREAS, the Town Board of the Town of Stafford has been considering entering into an Agreement with Stafford Fire Department, Inc. for the provision of Fire Protection Services for the Stafford Fire Protection District; and
WHEREAS, Stafford Fire Department, Inc. has agreed to provide such fire protection services for the Stafford Fire Protection District for consideration in the sum of $406,000.00 annually; and
WHEREAS a notice of public hearing regarding the proposed Fire Protection Agreement was duly published and posted as required by law including being advertised in the official newspaper of said Town; and
WHEREAS, said public hearing was held on December 9, 2024 and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed agreement, or any part thereof; and
WHEREAS, the Town Board having considered such comments received at the public hearing, feels it is in the best interest to enter into the Agreement; and
NOW ON MOTION OF Councilman Young which has been duly seconded by Councilman Panek, be it

RESOLVED, by the Town Board of Town of Stafford that it is in the best interest of the Town of Stafford to enter into this Agreement for Fire Protection Services; and be it further
RESOLVED, by the Town Board of the Town of Stafford that it hereby authorizes Robert Clement and other Board Members to sign the Agreement for and Fire Protection Services for the Fire Protection District located in the Town of Stafford.

WHEREAS Section 467 of Real Property Tax law allows local governments to increase income eligibility for the senior income exemptions by local law, provided the municipality already has such an exemption in place; and

WHEREAS, the Town of Stafford already has such an exemption in place, having adopted Local Law No. 1 of 1977 providing for a Senior Income Exemption pursuant to Section 467; and
WHEREAS the Town Board desires to bring its income eligibility scale in line with the scale adopted by the Genesee County Legislature on the 28th day of February, 2024; and
WHEREAS, on that date, the Genesee County Legislature adopted the following Over Age 65 Sliding Tax Exemption scale:
Less than $23,800 50%
Equal to or more than $23,800 but less than $24,800 45%
$24,800 but less than $25,800 40%
$25,800 but less than $26,800 35%
$26,800 but less than $27,700 30%

; and
WHEREAS the Town Board of the Town of Stafford found it in the best interest of the Town to hold a public hearing to consider the amendment of such local law; and

WHEREAS notice of such public hearing was placed in The Batavia Daily News, the Town’s Official Newspaper, on the 27th day of November; and
WHEREAS, such public hearing was held on December 9th, 2024, pursuant to the aforementioned Notice of Public Hearing, whereat all interested parties and citizens were heard and none raised serious objection to the above listed amendment; and
WHEREAS the Town Board considered public comment and finds it in the best interest to adopt this Local Law.
WHEREAS, with no serious objections raised, the Town shall pass Local Law No. 2 of 2024 to amend Local Law No. 1 of 1977.
NOW ON MOTION OF Councilman Young which has been duly seconded by Councilman Panek, be it
RESOLVED, by the Town Board of the Town of Stafford hereby passes Local Law No. 2 of 2024 entitled: “A Local Law of the Town of Stafford Providing a Partial Exemption from Taxation to Persons Sixty-Five Years of Age or Older Pursuant to the Provisions of Section 467 of the Real Property Tax Law.” This Local Law amends Local Law No. 1 of 1977 entitled “A Local Law to Establish the Level of Owner’s Income form Exemption of Real Property Taxes Pursuant to Section 467 of the Real Property Tax Law,” doing so to bring its Senior Income Exemption scale in line with that of the Genesee County Legislature on February 28th, 2024.
AND BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to enter the adoption of said Local Law in the minutes of this meeting, to file the law in the Office of the Town Clerk, and to file the law with the Secretary of the State of New York within twenty days pursuant to Section 27 (1) of Municipal Home Rule; and be it
FURTHER RESOLVED, that pursuant to Section 27 (3) of Municipal Home Rule this law shall take effect upon the date it is successfully filed with the Secretary of State.

WHEREAS the fee for this contract based on the current project scope will increase by $2,400.00 to cover the work needed to close out the WD #12 and not to exceed $66,480.00

RULES FOR PUBLIC HEARING
- The Supervisor/Chair shall maintain order at all board meetings and public hearings.
- All meeting attendees will be required to sign a Sign-In Sheet upon arrival.

- The public shall be allowed to speak only during a public hearing or during the public comment period of the meeting or at such other times as a majority of the Board shall allow.
- All meeting attendees interested in addressing the Board shall mark on the Sign-In Sheet that they wish to speak.
- Only one (1) person will be allowed to speak at any given time.
- Any person wishing to speak at a meeting or public hearing will have three (3) minutes in which to do so, the Supervisor/Chair may allow a speaker to continue if time permits.
- The speaker will be asked to stand up and state his/her full name and address before asking any questions or making any comments and/or statements. Speakers should speak slowly, deliberately and be as brief as possible.
- The substitution of speakers by the public is not allowed.
- A Speaker addressing the Board shall address his/her remarks to the Board only and not to other members of the audience in the form of a debate. All questions, comments and/or statements will be directed to the Board as a whole and not to any individual member thereof.
- The Board is not obligated to respond to public comments.
- Any person wishing to submit a written statement to be read into the record shall provide said statement to the Supervisor/Chair at the beginning of the meeting/public hearing.
- The use of handheld sound or video recording devices by the public is allowed unless the recording devices or their use interrupt and interfere with the orderly conduct of the meeting/hearing or with the ability of the public to hear or see the proceedings.
- Speakers should realize that speaking about items on the agenda and making public comments at board meetings is a privilege, not a right. Those who attend such meetings and decide to freely speak out and voice their opinions should fully realize that their comments and remarks are being made in a public forum.

WHEREAS Lumsden McCormick has performed audits for the Town of Stafford previously and are seeking their expertise for this audit and,
WHEREAS Lumsden McCormick is requesting a fee of $21,000.00 to perform the audit and a signature from the Supervisor
THEREFORE, BE IT RESOLVED THAT the Town Board of the Town of Stafford authorizes the Supervisor to sign the agreement with Lumsden McCormick to perform the audit for the year 2024 for a fee of $21,000.00.

The possibility of a Local Law for the Right to Farm Law was discussed. This is because we do not have a Local Law in place yet; it has been discussed but the Board feels it is time to put one in place to protect the farmers. The Town has examples from the Town of York and Town of Covington and will also look at the Town of Elba to design a Local Law for the Town of Stafford.

Public Comments were made by Cathy Worthington regarding Water District #12, the $60.00 maintenance fund is included in the debt service the residents pay; Water District #12 is not closed yet and the audit we discussed earlier, the cost will be incorporated with Water District #12 because of the expenses incurred.
The CEO/ZEO report, this month the Officer noted that he is closing out inspections, doesn’t he normally do that? Yes, he does.
The ARPA funds were questioned, and they are on track.
Charlie Giacchino asked if the resolutions could be posted on the website in full before the meeting, the Town Clerk will consult the attorney on this matter. Another question was about the speed limit on Transit Rd. where are we now with this? This is initiated at the County level after the Town has an inquiry for it and from there it goes to the Transportation Council where they look into the number of accidents or fatalities. Our Highway Superintendent will look into this further.
Barbie Starowitz is concerned about the Right to Farm Local Law, she saw this on the posted agenda and that is why she came to the meeting to find out where the Town is on this and of what it will comprise.

Andrew Darling asked where the Town is in relation to updating the Comprehensive Plan, it has been quite a while since the Plan was written and should be addressed. Councilman Panek asked if the Town has had any changes since the last update and noted that soon the Town should have a Right to Farm Local Law and that should be included in the revised Comprehensive Plan; the Board will ask for the Planning Board Chairman’s opinion on this matter.
Councilman Panek reported that he has four candidates for the Zoning Office position and will interview them on Saturday, December 14, 2024. All four need to be certified, two are from Stafford, one from Byron and one from Churchville. Councilman Young will accompany him in the interviews.
Councilman Duyssen reported that the emissions for vehicles are increasing by 2027. The Town should look into this to be prepared because it will be very costly.
Councilman Panek made a motion to adjourn the meeting at 9:17pm, second by Councilman Young and approved on a 5-0 vote.
