Supervisor Clement opened the Public Hearing at 1:37pm on December 19, 2024 by reading the Public Hearing Notice. Present at the meeting were Councilman Young, Councilman Duyssen, Councilman Pacer and Town Clerk Radley, Councilman Panek was absent.
No residents were in attendance.
Councilman Pacer made a motion to approve Resolution 94 To Schedule a Public Hearing Regarding Passing a Local Law to Amend Income Eligibility for The Senior Income Exemption, second by Councilman Duyssen. The motion passed 4-0-1, Councilman Panek was absent.

RESOLUTION 94 TO SCHEDULE A PUBLIC HEARING
REGARDING PASSING A LOCAL LAW TO AMEND INCOME ELIGIBILITY FOR THE SENIOR INCOME EXEMPION

The Town Board of the Town of Stafford met at a regular board meeting at the at the Town Office located at 8903 Route 237, Stafford, New York, on the 19th day of December 2024, commencing at 1:30 p.m. and the following members were:

Council Member Terry Young
Council Member James Duyssen
Council Member Robert Pacer
Absent Council Member Ronald Panek
WHEREAS, all Board Members, having due notice of said meeting, and pursuant to Article 7, §104 of the Public Officers Law, said meeting was open to the general public and due and proper notice of the time and place whereof was given as required by law; and
WHEREAS Section 467 of Real Property Tax law allows local governments to amend income eligibility for the senior income exemptions by passing a local law, provided the municipality already has such an exemption in place; and
WHEREAS, the Town of Stafford already has such an exemption in place, having adopted Local Law No. 1 of 1977 providing for a Senior Income Exemption pursuant to Section 467; and
WHEREAS the Town Board desires to bring its income eligibility scale in line with the scale adopted by the Genesee County Legislature on the 28th day of February, 2024; and
WHEREAS the Town Board is considering the adoption of Local Law No. 2 of 2024 entitled “Providing a Partial Exemption from Taxation to Persons Sixty-Five Years of Age or Older Pursuant to the Provisions of Section 467 of the Real Property Tax Law” to achieve this purpose; and
WHEREAS the Town Board of the Town of Stafford finds it in the best interest of the Town to hold a public hearing to consider such a local law.
NOW ON MOTION OF Councilman Pacer which has been duly seconded by Councilman Duyssen, be it
RESOLVED, by the Town Board of the Town of Stafford will hold a public hearing on the proposed local law on the 19th day of December 2024 at 1:30 p.m., at which time all interested parties and citizens for or against the proposed amendment will be heard; and be it further
RESOLVED, the Town Clerk is hereby directed to publish a Notice of Public Hearing in the Town’s official newspaper, and such Notice shall also be posted to the Town bulletin, along with a copy of the proposed local law; and be it further
RESOVLED, the Town Clerk is hereby direct to make a copy of such proposed Local Law which should be made available for public review at the Town office.

RESOLUTION 95 TO ADOPT LOCAL LAW NO. 2 OF 2024: A LOCAL LAW OF THE TOWN OF STAFFORD AMENDING LOCAL LAW NO. 1 OF 1977 TO PROVIDE A PARTIAL EXEMPTION FROM TAXATION TO PERSONS SIXTY-FIVE YEARS OF AGE OR OLDER PURSUANT TO THE PROVISIONS OF SECTION 467 OF THE REAL PROPERTY TAX LAW

The Town Board of the Town of Stafford met at a regular board meeting at the at the Town Office located at 8903 Route 237, Stafford, New York, on the 19th day of December 2024, commencing at 1:30 P.M. and the following members were:

WHEREAS, on that date, the Genesee County Legislature adopted the following Over Age 65 Sliding Tax Exemption scale:
Less than $23,800 50%
Equal to or more than $23,800 but less than $24,800 45%
$24,800 but less than $25,800 40%
$25,800 but less than $26,800 35%
$26,800 but less than $27,700 30%
$27,700 but less than $28,600 25%
$28,600 but less than $29,500 20%
$29,500 but less than $30,400 15%
$30,400 but less than $31,300 10%
$31,300 but less than $32,200 5%
; and
WHEREAS the Town Board of the Town of Stafford found it in the best interest of the Town to hold a public hearing to consider the amendment of such a local law; and
WHEREAS notice of such public hearing was placed in The Batavia Daily News, the Town’s Official Newspaper, on the 14 day of December; and
WHEREAS, such public hearing was held on December 19th, 2024, pursuant to the aforementioned Notice of Public Hearing, where at all interested parties and citizens were heard and none raised serious objection to the above listed amendment; and
WHEREAS the Town Board considered public comment and finds it in the best interest to adopt this Local Law.
WHEREAS, with no serious objections raised, the Town shall pass Local Law No. 2 of 2024 to amend Local Law No. 1 of 1977.
NOW ON MOTION OF Councilman Young which has been duly seconded by Councilman Pacer, be it
RESOLVED, by the Town Board of the Town of Stafford hereby passes Local Law No. 2 of 2024 entitled: “A Local Law of the Town of Stafford Providing a Partial Exemption from Taxation to Persons Sixty-Five Years of Age or Older Pursuant to the Provisions of Section 467 of the Real Property Tax Law.” This Local Law amends Local Law No. 1 of 1977 entitled “A Local Law to Establish the Level of Owner’s Income form Exemption of Real Property Taxes Pursuant to Section 467 of the Real Property Tax Law,” doing so to bring its Senior Income Exemption scale in line with that of the Genesee County Legislature on February 28th, 2024; and be it further
RESOLVED, that the Town Clerk is hereby directed to enter the adoption of said Local Law in the minutes of this meeting, to file the law in the Office of the Town Clerk, and to file the law with the Secretary of the State of New York within twenty days pursuant to Section 27 (1) of Municipal Home Rule; and be it
FURTHER RESOLVED, that pursuant to Section 27 (3) of Municipal Home Rule this law shall take effect upon the date it is successfully filed with the Secretary of State.

RESOLUTION TO HIRE A PART-TIME ZONING OFFICER
WHEREAS the Town of Stafford is seeking to fill the position of Part Time Zoning Officer and,
WHEREAS the Town of Stafford has advertised the position and conducted interviews for the position of Part Time Zoning Officer and
WHEREAS the Town of Stafford has chosen John Pestillo for the position of Part Time Zoning Officer for a rate of $11,700.00 per year from line A3620.1.
THEREFORE, the Town of Stafford will hire John Pestillo for the position of Part Time Zoning Officer at a rate of $11,700.00 from line A3620.1 to begin January 1, 2024.
